This Disclaimer applies to the website ernestmcleod.com (the “Site”), the Strategy-Based Cessation Training for Hypnotherapists program (the “Program”), and any advertising for the Site or the Program, including advertising placed on Meta platforms (Facebook and Instagram). It is in addition to our Terms and Conditions and Privacy Policy.

1. Educational and professional purpose only

The Site, the Program, and all associated Materials are provided for educational and professional development purposes only. They are intended for practising hypnotherapists and other professionals working in the cessation and behaviour-change field.

Nothing on the Site or in the Program constitutes medical advice, psychological advice, financial advice, legal advice, or therapeutic advice. The Program does not certify, qualify, or register any participant as a health practitioner under any law, including the Health Practitioner Regulation National Law (Australia).

2. Not a substitute for professional care

The Program is not therapy and is not a substitute for diagnosis, treatment, or care by a qualified medical, psychological, or allied health professional. If you (or someone you are working with) are experiencing a health concern, please seek advice from a qualified professional.

3. Results disclaimer

Any outcomes or results referenced on the Site or in the Program (including the statement that over 80% of smoking and vaping clients in our practice cease use after their first 90-minute session) describe results observed in our own practice with our own clients, under our specific delivery conditions. They are reported in good faith based on our records.

These results are not a promise, prediction, or guarantee of the results you will achieve in your own practice. Outcomes vary depending on many factors, including each practitioner’s skill, experience, client population, and adherence to the protocols taught.

Past performance is not an indicator of future results.

4. Testimonials

Testimonials, case studies, and client messages displayed on the Site reflect the personal experiences of those individuals. They are shared with the author’s permission. They are not representative of, and should not be taken as a guarantee of, the experience or results of any other person.

Where testimonials reference specific outcomes — including income figures, client volumes, or success rates — those figures reflect the testimonial author’s individual circumstances. They are not typical results and should not be taken as a representation of what you will achieve.

5. Earnings and business outcomes

Where the Site or the Program references the commercial benefits of specialising in cessation work — such as building a cessation specialty within your practice or generating income from cessation clients — these references are illustrative only. They are not earnings claims, income guarantees, or representations about the financial results you will achieve.

Any commercial outcome from completing the Program depends on factors outside our control, including the participant’s own marketing, business development, geographic location, regulatory environment, and skill in delivering the protocols. We do not guarantee any income or commercial outcome.

Specific income figures referenced on the Site, in advertising, or in testimonials (for example, dollar amounts attributed to particular participants) reflect individual outcomes only. They are not typical, average, or guaranteed.

6. Cessation, health claims, and regulatory positioning

The Program teaches a methodology for working with clients seeking to cease smoking, gambling, or vaping. It does not represent that hypnotherapy is a treatment, cure, or replacement for any medical, psychiatric, or pharmacological intervention.

Hypnotherapy is not currently regulated under the Australian Health Practitioner Regulation National Law, and we do not represent that completing the Program registers you as a health practitioner. You are responsible for ensuring that your own practice and marketing comply with all applicable laws, including the Australian Consumer Law, the Therapeutic Goods Advertising Code (where applicable), and any rules or codes of any professional association you belong to.

Each of the three courses within the Program (smoking cessation, gambling cessation, and vaping cessation) has been assessed and accepted by the Australian Hypnotherapists Association (AHA) for 10 CPD points, totalling up to 30 CPD points for participants who complete all three courses. Whether other professional associations, registration boards, or membership bodies recognise these CPD points toward your specific CPD requirements is a matter for each individual body to determine. We do not represent that any other body recognises or accredits the Program.
