Terms and Conditions

These Terms and Conditions (“Terms”) govern your enrolment in and use of the Strategy-Based Cessation Training for Hypnotherapists program (the “Program”) offered by Ernest McLeod, trading as The Hypno Coach (“we”, “us”, “our”). By enrolling in the Program, you agree to be bound by these Terms. If you do not agree, please do not enrol.

1. Definitions

In these Terms:

• “Participant”, “you” and “your” mean the person enrolling in the Program.
• “Program” means the Strategy-Based Cessation Training for Hypnotherapists program, including the smoking, gambling, and vaping cessation training modules, live calls, recordings, workbooks, scripts, community access, and any related materials we provide.
• “Materials” means all content provided as part of the Program, including videos, recordings, scripts, protocols, workbooks, and written content.
• “Site” means ernestmcleod.com and any sub-pages.

3. Eligibility

The Program is intended for practising hypnotherapists and other professionals working in the cessation and behaviour-change field. By enrolling, you confirm that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding contract.
• You will use the Materials in your own professional practice and will not redistribute, resell, or republish them.

4. What the Program includes

Subject to your payment in full, your enrolment includes:

• Unless clearly stated otherwise, the Program comprises three courses: Smoking Cessation, Gambling Cessation, and Vaping Cessation.
• Each course includes 4 live training calls of approximately 90 minutes each, delivered via Google Meet.
• Lifetime access to recordings of those live calls, made available within approximately 24 hours of each call.
• Workbooks for each subject.
• Session scripts and protocols used in our own practice.
• Access to the private community for 12 months from your enrolment date.
• Each course is recognised by the Australian Hypnotherapists Association (AHA) for 10 CPD points on completion, with manual certificates issued by Ernest McLeod.
• Lifetime re-attendance privilege for future live deliveries of the Program at no additional cost.

We may from time to time make changes to the Program that improve its content or delivery. We will not materially reduce what is included after you have enrolled.

5. Schedule and delivery

Live calls are scheduled on Wednesdays at 6:00 PM Sydney time, unless otherwise notified. The schedule for each intake will be confirmed by email after enrolment. If a live call needs to be rescheduled, we will give you reasonable notice. Live calls are recorded; if you do not wish to be recorded, please disable your camera and microphone or notify us in advance.

6. Fees and payment

The fee for the Program is AU$97 (or such other amount as is shown on the Site at the time of your enrolment). All amounts are in Australian dollars unless otherwise stated.

Payment is processed by SureCart at the time of enrolment. We may issue tax invoices automatically by email. We are not currently registered for GST. The Program fee shown is the total amount payable; no GST is added to or collected from the fee.

Where applicable to your circumstances, the Program fee may be deductible as a professional development expense. We do not provide tax advice; please consult your accountant.

7. 7-day refund policy

If you are not satisfied with the Program, you may request a full refund of the fee paid by emailing us at ernest@ernestmcleod.com.au within 7 days of your enrolment. We will process the refund within a reasonable time, normally within 5 business days of confirmation. On refund, your access to the Program portal, recordings, and community will be revoked.

After 7 days, no refund is available except where required by law (see Section 13).

Refund requests are governed by the Refund Policy at ernestmcleod.com/refund-policy/, which forms part of these Terms.

8. Access to the Program and Materials

On enrolment, we will issue you with a personal account on the course portal (Upcoach). Your account is for your sole use. You must not share your login credentials with any other person. We may suspend or terminate your access if we reasonably believe your account has been shared or otherwise misused.

“Lifetime access” to recordings means access for as long as we maintain the Program portal. We will give you reasonable advance notice if we plan to retire the portal.

9. Intellectual property

All Materials are owned by Ernest McLeod or licensed to us. By enrolling in the Program, you are granted a limited, personal, non-exclusive, non-transferable licence to:

• Access and view the Materials for your own learning.
• Use the protocols and scripts in your own one-to-one client work.
• Adapt the protocols to suit your individual clients within the bounds of professional practice.

You must not, without our prior written consent:

• Copy, reproduce, republish, upload, post, transmit, distribute, or share any of the Materials.
• Use the Materials to deliver group training, courses, workshops, or programs to other practitioners or to the public, whether for fee or free of charge.
• Sell, resell, sub-license, or commercialise the Materials in any form.
• Use our name, brand, or program name in your own marketing in a way that suggests endorsement or partnership.

Breach of this section is a material breach of these Terms and we may terminate your access without refund.

10. Community guidelines

As part of your enrolment, you have access to a private community for 12 months. By participating, you agree to:

• Treat other participants with respect and professional courtesy.
• Maintain client confidentiality. Do not share identifying client information in posts or discussions.
• Not solicit business from other participants without prior consent.
• Not post unlawful, defamatory, harassing, or discriminatory content.

We may remove posts and suspend or terminate community access for breaches of these guidelines, without refund.

11. Confidentiality

Discussions during live calls and within the community may include sensitive professional and clinical information. You agree to keep all such information confidential and to use it only in connection with your own professional practice and learning.

12. Limitation of liability

The Program is delivered as a professional development resource. We make no guarantee that participating in the Program will produce any specific commercial, clinical, or professional outcome in your practice.

To the maximum extent permitted by law, our total liability to you in connection with the Program (whether in contract, negligence, or otherwise) is limited to the amount you paid for the Program. We are not liable for any indirect, consequential, or special loss, including loss of profits, loss of business, or loss of clients.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

13. Australian Consumer Law

Where the Program is supplied to you as a consumer (within the meaning of the Australian Consumer Law), our services come with guarantees that cannot be excluded. You are entitled to a refund or to have the service supplied again if it is not provided with due care and skill or is not fit for purpose. For a major failure with the service, you are entitled to choose between cancellation and a refund or compensation for the reduced value.

14. Termination

We may suspend or terminate your access to the Program if you breach these Terms, including if you misuse the Materials, share your account, or behave in a way that is harmful to other participants. We may also terminate the Program as a whole if it becomes commercially unreasonable to continue, in which case we will refund a pro-rata portion of the fee for any live calls not yet delivered.

15. Professional and health disclaimer

The Program is professional development training for hypnotherapists. It is not therapy. It is not medical advice. It does not certify, qualify, or register you as a health practitioner under any law, including the Health Practitioner Regulation National Law. You remain solely responsible for your own clinical decisions, your compliance with any professional association requirements, and your own indemnity and insurance arrangements.

16. Privacy and advertising

Our handling of your personal information is governed by our Privacy Policy at ernestmcleod.com/privacy-policy/.

Advertising claims, results disclaimers, and outcomes are governed by our Disclaimer at ernestmcleod.com/disclaimer/.

17. Governing law and dispute resolution

These Terms are governed by the laws of South Australia, Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of South Australia and the courts competent to hear appeals from those courts.

Before commencing any legal proceeding, the parties agree to first attempt to resolve the dispute in good faith by direct negotiation, and where that is unsuccessful, by mediation.

18. Other

If any part of these Terms is found to be unenforceable, the rest of the Terms will continue to apply. A failure or delay by us in enforcing any right under these Terms is not a waiver of that right. These Terms are the entire agreement between you and us in relation to the Program and supersede any prior representations.

We may update these Terms from time to time. The version in force is the version published on the Site, with the “Last updated” date at the top. Continued use of the Program after a change constitutes acceptance of the updated Terms.
